Don’t Lose Income: Properly Install Amazon’s Affiliate Disclosure Policy

Every once in a while an account shutdown occurs that sends ripples throughout the online community. You’ve probably heard horror stories – a Blogger site is deleted, a Facebook Page disappears, an AdSense account is closed with no warning. The truly scary thing is, these corporations are so large there is often a “zero tolerance” policy in place and gleaning more information about what went wrong can be rough.

Recently I’ve heard several cases where Amazon has revoked access to a blogger’s affiliate account, due to a failure to follow Amazon’s affiliate disclosure policy. The email blogger’s receive looks something like this >>>

Dear Associate,

While reviewing your account, we have noticed that your website contains links to Amazon that are not properly labeled, which makes it unclear that you are sending customers to the Amazon website.

The Associates Program Operating Agreement that governs your participation in the Associates Program requires that links to an Amazon Site must not be confusing or misleading, and must be clear that they link to an Amazon Site. For more information, please review the Participation Requirements and Linking Requirements found here:

We insist that you cease this activity and remove all Amazon content from your site(s) immediately. Moreover, because you are using the Associates Program in violation of the Associates Program Operating Agreement, your account has been closed and you will not receive further payment. Any other accounts you may have or may open in the future which are found in violation of the Operating Agreement may be closed and advertising fees withheld without notification.

Hmmm. Okay…that’s no good. As someone who regularly uses Amazon as a source of income, it’s even a bit scary. I’d hate to loose a couple hundred dollars a month due to confusing or misleading links.

Hard to tell what it means though, right? All the vague statements and legalease can be more than a bit confusing.

Amazon Affiliate Disclosure Policy

What’s Amazon really looking for? Proper disclosure as outlined in Amazon’s affiliate disclosure policy. This is a bit different than what the FTC looks for. Initially I thought I was safe by simply placing a statement at the top of my site indicating that a post contained affiliate links as required by the FTC. Not so. Amazon is looking for a specific Amazon Associates statement found in the associates agreement (agreement #10).

You must clearly state the following on your site:

[Insert your name] is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to [insert the applicable site name (amazon.com or myhabit.com)].

Do  you have the Amazon Associates disclosure on your site? Take a minute and make sure it’s in a visible location.

My recommendation is to have the disclosure on every page. I like to be safe. You can easily do this by creating a new text widget in your sidebar or footer. Having said that, it may suffice to include the disclosure on a page located somewhere on your site. I’ve got it on my contact page.

How to Add the Amazon Affiliate Disclosure to Your Site

It’s really quite simple to add the Amazon affiliate disclosure statement to every page on your blog. I am sharing how I’ve added it to the bottom of my sidebar on WordPress, but the process is crazy similar on Blogger.

Navigate to the “Appearance” tab on the backend of your site. Select “Widgets” from the menu.

The Widgets page will look something like this…

Drag and drop that text widget into your sidebar (or footer, depending on where you’d like it to appear on the site. Copy and paste Amazon’s very specific disclosure statement and save.

    Perfect. Got it changed on mine. Does it matter how far down it is or just that its on there? I have it on the bottom of the side bar, on my contact page, and I also post it on every post that has affiliate links.

      Based on the information Amazon has provided, it must be on “each” page. They don’t actually specify where on the site, so technically I think that you’re okay as long as you’re also following the FTA guidelines and have the disclosure the way they’ve specified. xo

      Hey Jessica, I am not aware of any other affiliate program with a similar requirement. Most simply require you to disclose per the FTC. Amazon’s policy has been around for ages, so I am not sure if it’s a holdover that they simply like to enforce or if it’s necessary for some sort of legal reason…

      Hi Miranda, Legally you have to disclose any sponsor or affiliate relationships within the post prior to linking. It’s typically the easiest to put it right at the top of the post. All your disclosure needs to say is “This post contains affiliate links.” xo Tauni

      Hi Jessica, At the top of every post you should disclose if your post is sponsored, if you received free product and/or if there are affiliates. There is no required terminology. It can be as simple as “This post includes affiliate links” or “This post was sponsored by Disney.” Does that help? xo Tauni

I added my text box on Blogger, now I’m on the hunt for info about referring directly from Facebook (do I have to disclose every time?) and inside of an individual blog – do I have to begin the blog with “I’m an affiliate, blah blah blah”?

      Hi Melissa! Thanks for the questions. Yes. You do have to disclose every time you post on FB. I usually say something about the product and then put (affiliate link) right before the link. You also do need to disclose in any post you’re using links in. Technically the disclosure just needs to come before the link, but most people think it’s easiest just to do it at the top of the post.       If the privacy policy appears on every page of the website, you’re good to go. If it’s a separate page that people would not naturally navigate to in the course of visiting your site, it would be a problem. Good luck! Tauni

    Hi Tauni!

    I’m brand spank’in new to the whole affiliate world and I feel like I’m navigating through mud! I find it all so confusing. But enough with my whining! Lol.

    I was wondering if putting in my site name is sufficient in the “insert name here” or does it have to be MY name?

    I’m also having a doozy of a time trying to figure out if I need two separate disclosures for the .ca and .com since I’m a Canadian resident. Any insight here as well?

    Something similar happened to me too. They closed my account because “the web site includes the unapproved use of Amazon.com trademarked words, images, or reviews”. I did take some pictures from the products’ page and uploaded them on the blog because the ones that they give you in the HTML link builder look horrible. I don’t know exactly how to get rid of that ban and still use the nice pictures that I want. Do you have any idea how to fix this?

      Cristina, I agree that the photos in the link builder are not fantastic. I don’t use them. I personally use images provided by the manufacturer or that I have taken myself. Having said that, when they site you for this infraction it’s typically because you’ve uploaded an Amazon logo, quoted Amazon reviews, etc. Unfortunately, few people are able to reinstate their account. You could start a new one…Best of luck to you. –Tauni

However, I do still have one question. If I have it on my side bar and on my contact page do I need to write, “this post contains an affiliate link”? I feel like I read that a lot.

      Hi Piper, I am glad you found the post helpful. In terms of Amazon’s requirements, you’re good. However, the FTC requires that you disclose in every single post. So to be square with the federal government, you have to include it in every single post. This is one time where the two requirements do sort of seem to be a bit much. Good luck! xo Tauni

      Tony, I think the Footer might work…It needs to be clear and visible to anyone who visits your site. You do need to have it show up on any page where you might insert a link, so a policy or disclosure page that someone would have to click over to would not be sufficient. Good luck! Tauni

        I agreed the point you said in case it’s a pure affiliate site with all reviews and products. However, I have seen many tech news sites that sometimes add affiliate links to Amazon. But there’s no disclosure 🙂

    2. I have an ORANGE SMALL BOX that says AMAZON AFFILIATE DISCLOSURE PAGE and when you click on the it takes you to the disclosure page, good?

      I believe your website name would suffice, but you may want to vet that directly with Amazon. However, the answer to your second question is no. You have to have the full disclosure on any page where you have an affiliate link. The reader should not have to click. Good luck!

    Thank you for making this clear. I learned about this a few months back, but recently learned that a disclaimer has to also be on each post. Is that correct? I created an image that states a disclaimer on each post that I have links on, like this one >>> http://spanglishspoon.com/how-to-make-almond-milk/, but I’m wondering if that’s even necessary if I already have it on my sidebar. Have you heard anything about having disclaimers on the post themselves?

      Hi Stephanie, Amazon requires their specific disclosure be placed on every page where there are affiliate links (like the sidebar). The FCC requires disclosure within a post. There is no specific language for to meet federal regulations. You simply have to disclose that the post contains affiliate links and/or is sponsored at the beginning of each post. It’s really too bad they’re not “on the same page” right? Good luck! Tauni

    Hi Stephanie thanks so much for this. You have totally saved me from a potentially horrible mistake! I have added it as a widget on the footer of my site.. although I’m worried that no one will see it until they of course scroll ALL the way to the bottom… does this matter and should I change it to a sidebar where more will see it?

    Not sure if this makes a difference to Amazon, just as long as it is somewhere on the site?

    Also, I use Commission Junction too, do you know if they require a disclosure statement? If so, would you recommend stacking this disclosure on top on the Amazon one? I’d love any ideas to make it look a bit more tidy. I am still very new to all this… I greatly appreciate your time and help… Thank you so much. 🙂

      Hi Jen, I am not sure how strict Amazon is with where the information is placed. Their policy suggest that the disclosure be easily accessible to the reader, so your footer may not be specific enough.

      I am not aware of any disclosures specific to Commission Junction, but if you’re using affiliate links in a post the FTC requires that you disclose use of affiliate links in the post BEFORE the links appear. Most people tend to put those disclosures at the top of their post.

      Hi! Amazon doesn’t require the disclosure be placed at the top. However, the Federal Trade Commission has ruled that an affiliate links or sponsored content be disclosed BEFORE discussion of the product or links appear in the post. Best, Tauni

I had applied termly policy, and everytime I published it said that my website collected user personal information and data such including thier password.

          Hi, A privacy policy is not required by the FTC in the United States, however the EU does require notification that your site uses “cookies” to track visitor information. If you have traffic from any of the European nations on your site, you will want to include that notification. Best, Tauni

    quick question… I’m have a side business and our millionaire upline is suddenly sharing links to amazon for these amazing things that we need. I suspect they are affiliate links, but she’s not disclosing that they are affiliate links. thousands of unsuspecting downline are just making her even more money if this is the case. it’s not sour grapes b/c she’s going to make a ton of money… it’s just what is required is required! Who regulates this?

    I actually just came across this via Google! I have the Amazon disclosure posted, but I don’t have “amazon associates disclosure” as the title. I just have Affiliate Disclosure and then the rest is underneath it. Is that acceptable or do I need to change the title? I’m sooo new to this!

      Kristi, I am honestly not sure if you’re in compliance or not. If an Amazon representative came to your site for a visit, would they be able to find the disclosure quickly? I always err on the side of caution so I would probably update it, but I don’t know if it matters. xo Tauni

      Hi Ann, The FTC requires that you disclose sponsors or affiliate links BEFORE a reader might click. I put mine at the top of my post, because I don’t write super long posts. If you’re posts are similar in length, you should be okay to post at the top as well. Amazon requires the language I have in my sidebar, so that’s a bit separate.
